New Mexico’s Allowed Marijuana Usage and Limitations

Marijuana usage laws in New Mexico are still rather strict, but the good news is that as long as they catch you with a smaller amount of weed, the punishment won’t be too severe. For example, getting caught with 1 ounce of weed on you will result in $50 to $100 in fines and a maximum of 15 days in jail.

As is the norm, first-time offenders are given a bit of a slack in terms of penalties, but should you find yourself in the same situation as a second-time offender, you will likely need to cough up $1,000 in fines and serve a whole year in prison.

Cultivators and distributors of marijuana are shown no mercy in New Mexico, which means the fines are high and prison time equally so (in fact, up to 18 years of jail-time await). Although recreational use is pretty much a no-go, at least you can legally smoke it if you’re granted a medical marijuana card. Of course, there are certain things to keep in mind even so (which we’ll go over in a minute).

For starters, please keep in mind you need to be seriously ill in order for them to even consider this is an option. Medical conditions such as cancer, HIV/AIDS, PTSD, ALS, chronic pain (and similar) are usually enough, but the final decision rests on the shoulders of your physician. In any case, you’re going to be required to be a resident of New Mexico and you can expect them to ask you for proof of residency before awarding you the card.

If you do manage to get one, you can legally acquire weed from one of the officially-approved dispensaries. Statistically speaking, however, they tend to turn away around 30 to 40 percent of patients since the law requires them to limit the total number of weed every patient is entitled to receive.

As for the quality of goods and the price you’re going to have to pay for it all, this all depends on various factors. But for the most part, a gram of weed tends to cost anywhere between $10 to $30. Also, you are not allowed to possess any more than 6 ounces of marijuana at any given time. The good thing is that as a medical marijuana card holder, you are allowed to grow up to 16 plants, as long as they are strictly kept for personal use only.

Unfortunately, no one is allowed to take any weed outside of the borders of New Mexico, as attempting to do so would constitute a federal crime. And no, not even as a medical marijuana card holder, you’re not allowed to smoke it anywhere you please, only in the privacy of your home.

It should come as no surprise that you’re not allowed to drive under the influence of drugs in New Mexico, which includes marijuana. If an officer pulls you over and suspects you of drunk or drugged driving, you can be administered a blood test which you must comply with, since the refusal of which is treated the same way as admitting the guilt.
