
Nevada’s Allowed Marijuana Usage and Limitations
Nevada is generally known for its tendency to tolerate various taboo activities, and marijuana is no exception either. Recreational marijuana users will be delighted to know they can enjoy their favorite pastime activity whenever they so please, with certain limitations of course.
Historically speaking, medical marijuana usage has been legal for quite a while in Nevada (since late 2000, in fact). As of November 2016, everyone who is 21 or older can freely smoke it for recreational purposes. Essentially, consuming weed has been effectively decriminalized in Nevada.
The state also provides all sorts of protection mechanisms for out-of-state medical marijuana license holders, so tourists can really enjoy their stay without needing to hold back on any kind of marijuana consumption habits they might have, as long as they’re willing to adapt to some of the local regulations that are still in place (we’ll cover them in detail at a later point).
To start off with, driving under the influence of marijuana is not a smart idea. While most other states allow the drivers to have less than 5 Nanograms/ml of THC in their blood, Nevada has set this limit to 2 Nanograms/ml. If you want to remain on the safe side, it’s best not to test the limits.
Ironically, cultivating marijuana without a proper medical marijuana license is considered a crime in places like Las Vegas and Reno, even though recreational use is entirely permissible. Another example which demonstrates that the matter of smoking weed in Nevada is not as clear-cut as you might think, is this: you aren’t allowed to simply walk down the street with it in general – however, there are certain public places that allow it.
You can expect to pay $600 in fines if you are caught smoking pot in public. Do bear in mind this number only applies to first time offenders and that the penalties increase for every subsequent offense.
Any pot acquired in Nevada must also be consumed within the state; you’re not allowed to take any across the borders, as attempting to do so is a federal crime.
Technically speaking, in most cases, you are allowed to cultivate cannabis in Nevada, as long as you bear in mind that certain regions do not allow it. In any case, the number should never surpass 12 plants at any given time, and you shouldn’t even be thinking about growing cannabis plants unless you’re located at least 25 miles away from the nearest dispensary.
Don’t be afraid to store marijuana in your car, at least if the total amount of it doesn’t exceed one ounce. However, as mentioned before, this still does not give you permission to smoke it inside of the vehicle, even if you own it. And no, not even the passengers are allowed to smoke it there.
When it comes to smoking pot in a workplace environment, be advised there are no laws in Nevada that would protect you from getting fired for it, so you are doing it at your own risk. In practice, this means that your superiors can establish their own rules and policies regarding marijuana usage, and even administer a test to check for traces of THC in your blood, then make a decision to let you go based on the results.
